Terms & Conditions

These Terms & Conditions ("Terms") govern the sale of products and services by Penny Crayon Custom Clothing to you, the customer. By placing an order with us, you agree to be bound by these Terms.

 

1. Ownership and Payment

 

  • Retention of Title: Products supplied by Penny Crayon Custom Clothing remain the property of the company until full and cleared payment has been received for the entire order.

 

2. Order Approval, Returns, and Refunds

 

  • Order Confirmation: An order confirmation, including artwork proofs, will be sent to you for final approval before production begins. By making payment or giving instruction to proceed, you confirm that all aspects of the job are approved, including artwork, garment specifications, quantities, and lead times.

  • Custom Garment Policy: We do not accept returns or issue refunds on completed, personalised garments that have been approved by the pre-production proofing process, unless there is a verified print error or manufacturing fault that falls outside of the acceptable tolerance levels.

  • Faulty Items Notification: Faulty items must be reported to Penny Crayon Custom Clothing via email within 7 calendar days of delivery. Items reported after this timescale will not qualify for replacement or refund.

  • Inspection of Faults: Reported faulty garments will be inspected by Penny Crayon Custom Clothing. If inspection determines that the fault was caused by improper care, misuse, or was not caused by a manufacturing or print error by the company, the item will not be replaced or refunded.

 

3. Customer Supplied Garments (CSG)

 

  • Risk: If you provide your own garments for printing or embroidery, this is done entirely at your own risk.

  • Damage Exclusion: While we take every precaution to ensure high-quality results, occasional damages, ruins, or rejects can occur during the production process (e.g., due to machinery malfunction or fabric incompatibility). Please note that Penny Crayon Custom Clothing cannot replace, refund, or reimburse the value of any customer-supplied items in such cases.

 

4. Artwork and Design

 

  • Artwork Format: Artwork should ideally be supplied in vector EPS format. If this format is not available, we may offer to convert or redraw the artwork for you.

  • Colour Accuracy: We do not accept responsibility if the colours of the final print differ from your original artwork and other printed materials, especially if specific colour references are not provided. To ensure colour accuracy, please specify Pantone references (e.g., Pantone 186 C) where possible.

  • Screen vs. Print Colour: Printed colours on a garment will always vary from the tones and Pantones viewed on a computer screen, tablet, or phone. We do not take responsibility for tonal differences resulting from on-screen viewing.

  • Pantone Dyed Garments: Colours of Pantone dyed garments (especially cotton) can show variation between dye lots. We do not accept responsibility for subtle changes of tone from previous orders or within large quantity orders.

 

5. Sizing and Fit

 

  • Size Charts: Our size charts are provided as guides and may not correspond directly to sizing used by other suppliers (whether worded or numerical).

  • Checking Fit: We strongly recommend requesting free samples for size checking if you are concerned about the fit before placing a large order.

 

6. Intellectual Property (IP)

 

  • Ownership of Our Designs: Original artwork and garment designs, including digital mock-ups and embroidery files, that have been created by Penny Crayon Custom Clothing will remain the property of the company.

  • Copyright Infringement: Reproduction of our original designs by another company or knowingly sending our files to competitors will be classed as a copyright infringement and theft of intellectual property.

  • Artwork Services Fee: Any bespoke artwork created by Penny Crayon Custom Clothing at the customer's request that does not result in a supporting order is charged at £[YOUR INPUT HERE - e.g., 50] per hour. By requesting artwork services, you are agreeing to this term.

 

7. Delivery and Couriers

 

  • Courier Responsibility: Penny Crayon Custom Clothing does not accept responsibility for third-party couriers.

  • Delays: We are not liable for any delays experienced with domestic or international deliveries, including those caused by customs clearance, random consignment checking, or other factors outside of our direct control.
